Contract Creation and Electronic Contracting

The technical steps required to create the contract between you and us are as follows:

  • You place the order/application for your products on this website by pressing the complete checkout/apply button at the end of the process. You will be guided through the process of finalising your transaction via this website.
  • We will send to you an acknowledgement email detailing the products you have ordered or applied for.
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions below.

Non-acceptance of an order/application may be a result of one of the following:

  • The product you ordered is not available from stock.
  • We were unable to verify the information you supplied to us.
  • We are unable to obtain authorisation for your payment.
  • A price or product description error is identified.  
  • You do not meet the eligibility to order criteria set out in the main Terms and Conditions.

The contract will be concluded in English.

Jewellery and Watches

View In Store Service

We offer a no-obligation service to view any of our retail items over £1,000 in one of our stores convenient to you. Our View in Store Terms and Conditions can be found below:

In order to process a View in Store request, we require an online deposit made on our website of £25 prior to processing the request. The deposit can be used towards the purchase of the requested item, and is refundable if you attend store to view the item, but decide for any reason you do not wish to buy the item.

PLEASE NOTE: In the event you do not attend store within the 5 days to view the item, the deposit is not refundable.

1. You will have 5 working days to view your item once it has arrived in your local store, we will text and email you to let you know the item(s) have arrived instore. After five days, the item will be released for general sale.

2. Please note if an item is marked as 'Online Only' then it is not available to be viewed in a local store.

3. A maximum of 2 active requests for View in Store can be made at any time, a deposit of £25 is required for each individual item. Any additional requests will be rejected. If the item you wish to view is valued at £5,500 or above, you will be restricted to 1 item request for View in Store at a time.

4. Photo ID is required during your visit, e.g Driving Licence or Passport to view the item.

5. All View in Store requests will be processed within standard office hours. Please Note: whilst we do our very best to approve each request, there may be instances when this is not possible. At any stage of a View in Store, including after approval, as hard as we try to prevent this, cancellation may still occur. In such cases, you will be notified.

As our watches are offered both in our stores and online, to avoid disappointment we encourage you to use our Click and Collect service available through the basket to secure your order. The Click and Collect 30 day Returns Policy can be found here.

6. We reserve the right to refuse our View in Store service to any individual or company. All View in Store requests are approved at our sole discretion.

7. We reserve the right to amend the Terms and Conditions of this service or to withdraw it, at any time.

Pre-Owned Watches : Warranty, Terms & Conditions

All watches have been authenticated by our in-house accredited horologist. We cannot guarantee that boxes or other packaging supplied with items are authentic.

All watches displayed on this website are shown with photographs and/or video of the physical item itself. As a pre-owned watch specialist, some watches may show signs of use and wear, which is often commensurate with age. We encourage customers to carefully inspect the photographs or use our View In Store service if they have concerns over the condition of an item.

Watch movement is covered under this warranty; however, this does not apply to any inappropriate damage caused by mistreatment of the watch or normal wear and tear. This warranty does not cover damage to bezels, bracelets/leather straps, cases, crystals, and glasses. The warranty does not cover accidental damage or loss and is not transferable.

Unless otherwise stated Diamond Dials/Bezels are classified as custom made.

It is important to note that mechanically powered watches such as Rolex, Cartier, Breitling, Omega etc will never keep time as accurately as a quartz watch, a loss or gain of 10 seconds per day is deemed acceptable.

Dated items give an approximate manufacturing date, watches that are sold with their original paperwork will be listed by the date sold on the paperwork, you acknowledge that the date of manufacture may be significantly earlier than the paperwork date.

Although we make reasonable efforts to ensure product information is accurate, we make no guarantees that the content on our site is free from errors or omissions, complete or up to date. Product dimensions and weights supplied are intended to give an approximate indication.

No watch should be treated as water resistant unless specifically stated so by us. Where watches are sold as water resistant please see the below table to explain which activates are suitable for various water-resistant depths.

New Jewellery

We guarantee that all of our new jewellery is compliant with EU UK Reach Regulations (January 2021) and within legally acceptable nickel, cadmium and lead limits.

Care & Repair – Watches

Our watch care and repair service is administered through our group company Swiss Time Service. Swiss Time Services T&C’s relating to the care and repair service can be found here. Please read these terms and conditions carefully before submitting your item for repair.

Diamonds & Gemstones

All dimensions and estimated weights of diamonds and gemstones have been determined without unsetting the stones and are, therefore, only approximate because of limitations imposed by the mount. Estimated weights are normally calculated by applying standard formulae to the measurements taken.

Diamond colour and clarity assessments are an opinion only, and both colour and clarity can be estimated only because of limitations imposed by the mount. The quality nomenclature used is that recommended by the GIA (The Gemological Institute of America). Gemmological descriptions of diamonds and gemstones, including disclosure of treatments, are based on testing carried out by standard gemmological equipment without unsetting the stones.

Whilst reasonably satisfied that all such descriptions are correct, no responsibility can be assumed if subsequent unsetting and testing disproves these opinions. In the event of serious doubt, it is recommended that independent testing is undertaken by a recognised gemmological laboratory.

Children's Jewellery

Our Children’s Jewellery ranges are designed for little ones aged three and above, we have created the guidelines below to keep them safe:

Most importantly, your little one should not be left unsupervised whilst wearing jewellery, and jewellery should not be worn if they are playing, doing activities or sleeping. Jewellery should also not be worn for prolonged periods of time.

Some smaller items, such as earrings, are a choking hazard, so please ensure any jewellery is not put in the child’s mouth. Earrings should also be cleaned after being worn, it is best to do this with warm soapy water, and then dry the item(s) with a clean cloth.

As your little ones get older and grow, it's likely that jewellery may become tighter or no longer fit, please do not wear them if they are tight or uncomfortable.

Pierced Items (Earrings & Body Jewellery)

For pierced items received in sealed bags, we can accept refunds within the usual 30 day period provided they are returned in their original, unopened packaging. If you are returning your pierced jewellery please ensure the plastic bag for your jewellery remains sealed. Please note: If the items have been removed from the sealed bag or if the bag has been tampered with or unsealed in any way, we cannot refund the item due to hygiene reasons.

It is always possible that some of the items we sell may be incorrectly priced. If this does occur, you will be contacted as soon as possible to inform you of the error. Once we told you about an error in the price of the product you have ordered, you will be given the option of buying the goods at the correct price or cancelling the order. In the event the payment has been processed this will be refunded. If we cannot get in contact with you to notify you of the error, your order will be cancelled.

Customer Terms and Conditions for Bullion and Coins Instore & Online Purchases from Harvey & Thompson

By placing an order (‘Order’) through Our website You (the customer) acknowledge and agree to the following Terms and Conditions. The Terms and Conditions and the Order form the Agreement between us.  

You must be aged 18 or over to place an Order for bullion or coins.

If you do not wish to accept these Terms and Conditions, please do not place an Order.

1.  Orders

You may submit Orders for Goods by completing the relevant request using Our webpages located at handt.co.uk.

Harvey & Thompson Limited (We/Us/Our) agree to supply the Goods ordered subject to availability.

3.   We use a third party supplier, Baird & Co Limited (‘Baird’s) to fulfil your Order and therefore there may be occasions when the item you have ordered is not available from Baird’s.

Timing of Orders

We will use our best endeavours to process your order within 7 business days of receipt. Please note your Order will only be accepted upon receipt payment of cleared funds and until we receive such sums your Order will be pending.

We shall use our best endeavours to ensure that the Goods;

(a) correspond with their description on our website.

(b) are of satisfactory quality within the meaning of the Sale of Goods Act 1979 (as amended) and fit for such purpose as might reasonably be expected for an item of its type

(c) are free from defects and remains so for at least 30 business days after your receipt of them and

(d) comply with all applicable, statutory and regulatory requirements concerning such Goods.

3. Supply and Delivery

3.1 We have engaged Baird’s to deliver the Goods to you and it is a condition of this agreement that you permit Us to share your personal details sufficient to fulfil your order with Baird’s. Details of how we keep your personal data safe are included at section https://handt.co.uk/pages/privacy-policy  concerning Data Protection.

In most cases Baird’s will supply your Goods by post and in accordance with the method specified in the Order Form.

3.2   Unless otherwise stated, delivery will be made by Royal Mail Special Delivery, or another pre-selected provider if the Goods are below £2,500 in value. If the value of your order is above £2,500, it may be delivered by UPS or another provider of our choice.

3.3   Once you have been notified of a delivery, it is your responsibility to be available to accept deliver at the specified time.

3.4   We only accept liability for parcels that are lost or damaged whilst in the care of Royal Mail or other pre-selected provider. Once the provider confirms delivery, and the parcel is no longer in their care, our liability and that of Baird’s, will cease.

3.5   It is imperative that you ensure you provide accurate postal address details. Royal Mail or any other provider shall have no liability to pay any compensation if the reason a parcel could not be delivered successfully was due to it not containing a full and accurate name and address, including postcode.

3.6   We strongly recommend ensuring that household insurance cover is in place in the event that items are lost whilst on your property.

4.   Title to Goods and Passing of Risk

Title to the Goods you have ordered shall pass to You at the point on time that We receive cleared funds from You in respect of the purchase price for the Goods. The risk of loss or damage to the Goods remains with Us until the delivery of the Goods to your delivery address by our agent Baird’s.

New section price and payment you will pay the price described on the H&T website for the Goods and will be asked to choose your delivery options for which variable pricing will apply.

5.  General

 5.1   Force measure

Neither H&T, nor Bairds shall be liable for any delay or failure to provide the Goods where such delay or failure arises as a result of events, circumstances or causes beyond their reasonable control.

5.2   Variation
H&T reserves the right to make changes to this Agreement from time to time. 

6.  Complaints

7.   Data Protection

You acknowledge that H&T is a data controller and that Baird’s is a data processor with whom We have in force a Data Processing Agreement which sets out the contractual arrangements between us so as to safeguard your personal data in accordance with applicable Data Protection legislation.

8.   Cancellation Rights

You have no statutory right to cancel Your order if You change Your mind, this is because the price of the goods is set at the time of the contracted Order, and due to the fact that the goods are constituted in gold and other precious metals there is a significant risk of price fluctuation.

9.   Description of the goods


It is Our responsibility to supply you with Goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations please contact us.

11 Rights of Third Parties

A person who is not a party to this Agreement shall not be able to enforce any of the terms and conditions contained in it. 

10.   Applicable law

This Agreement is subject to the laws of England, and Wales.

If you select to use this service, the terms and conditions of our Click and Collect service apply to this Agreement.

Investment advice

Neither H&T, nor Baird’s are authorised to give investment advice concerning Goods and by placing an Order You acknowledge that you have not received any investment advice in relation to your purchase. 

12.   Our Rights to Refuse to Supply

13.   We reserve the right to refuse to supply any individual or company and to limit the maximum quantities of individual Goods which may be purchased by any individual or company (whether per individual order or in aggregate).

14.   Refunds and cancellation
Please note these Goods are not subject to the Financial Services (Distance Marketing) Regulations 2004. Once an Order has been placed for Goods and these have been despatched to You, You have no right to cancel and You will NOT BE ENTITLED TO A REFUND ONCE YOU HAVE PLACED AN ORDER so please consider carefully prior to placing an Order with Us; this is because the price of the Goods is subject to changes in market value on a continuous basis.

The price of the Goods is fixed at the point in time Your Order is placed.


15.   Instore purchases - Refunds and Cancellation
Please note these goods are not subject to the Financial Services (Distance Marketing) Regulations 2004. Once an instore purchase has been placed for Goods, you have no right to cancel and You will NOT BE ENTITLED TO A REFUND ONCE YOU HAVE PURCHASED THE ITEM so please consider carefully prior to buying an item instore this is because the price of the Goods is subject to changes in market value on a continuous basis.

The price of the Goods is fixed at the point in time your purchase is made.

Fraud Prevention and Detection

General

  1. Before we provide services, goods or financing to you, we undertake checks for the purposes of preventing fraud and money laundering, and to verify your identity. These checks require us to process personal data about you.

All deliveries must be signed for at the delivery address (or upon collection), by you, or by your nominated representative who must be aged 18 or above. Under no circumstances will goods be left unattended, for example in a garage, or with anybody below the age of 18.

In the event that there is no one available to accept and sign for your delivery, a card will be left by the courier with instructions on what to do next.

General payment provisions

Any of the following cards may be used to pay Visa Debit (Delta), Maestro UK, MasterCard, Visa Credit.

All customers collecting their purchase, whether the registered customer or a third party, will be asked to provide a form of identification for the person who paid for the item. The identification must match the cardholder name shown in the payment details on the checkout page. The card itself will not be required.

As a result, we have developed highly secure online facilities.  This is specifically intended to give you confidence when you use your credit or debit card to make payments or to shop with us and when you tell us your personal details, such as your address or phone number.

Credit Card safety

The H&T websites use Secure Sockets Layer (SSL) technology to encrypt your details as they are being transmitted to us.  This prevents anyone from eavesdropping on your transactions with us and keeps your card and personal details private.

We allow you the option to store your card details with us, so that you can order from us again without needing to type your details in.  We only ever show you the last four digits of your card number on our public internet site and of course, this information is 'for your eyes only'.

If you do not wish to store your card details with us, you can enter these each time you carry out a payment or order.

Your payment details are held in a secure encrypted server which is not accessible from the Internet.  Access to this data is also secured internally within H&T and all card numbers are encrypted using a highly secure system that financial and banking institutions rely on, called Triple DES (Data Encryption Standard).  This is widely acknowledged as being a very secure way to protect your data.

Once your order is processed, the payment details associated with your order are removed from our files.

Returns Policy

We want you to be happy with your purchase. If you're not, please return the product to the shop where you purchased it within 30 days.

Vintage/Antique/Secondhand jewellery and watches are sold as seen and as such may show signs of wear and tear. This is to be expected for items of this nature.

Please note that your right to return retail products does not apply to goods made to your specification, that have been personalised on your behalf or which have in anyway been altered at your request.

If you wish to return retail items to us, they must be in the same condition that they were bought and have all accompanying packaging, guarantees and certification. Along with the original purchase receipt.

H&T Shop Online guarantees and returns

Customers are covered by our quality guarantee on every product. Should the customer not be entirely satisfied, H&T Shop Online will refund and replace any item subject to due compliance by the customer with these Terms and Conditions. Please contact the Customer Service team with any queries.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your local authority, Trading Standards Department or Citizens Advice Bureau.

Click and collect - FX

If you placed an order for collection at a H&T Store, this order can be cancelled at any time prior to collection by calling us using the telephone number found on the contact us page on www.handt.co.uk. Cancelled orders will be refunded at the full Sterling amount that you paid for your Travel Money. If you have placed an order for collection and you fail to collect your order from the nominated H&T store within 7 days of the collection time given to you then your order will be marked as uncollected and your order will be cancelled. The full Sterling amount that you paid for the Travel Money will be refunded to the card you used to place your order. If, after your order is cancelled you still want to purchase Travel Money from us, you will need to re-submit an order.

Mobile Access

This section of the Terms and Conditions applies (in addition to the remaining Terms and Conditions) when you access this website using a mobile application or a version of this website optimised for use on mobile devices (the "Mobile Access Channel").If you do not agree to be bound by any of these Terms and Conditions, you may not use or access the Mobile Access Channel and should, if applicable, delete any mobile application used to access the Mobile Access Channel.

The Mobile Access Channel is data intensive.  You are responsible for any carrier or other data charges incurred when using it, and we will be liable for any charges you incur.  We recommend you check with your network provider if you are unsure of the charges that may apply.

As we have no control over your device's network connection, we cannot represent or warrant that any information (including prices, product availability, and store information) is correct or up to date. In the event of a discrepancy, content and prices published on the main website/s will take precedence.  Prices shown on the Mobile Access Channel may also differ from those shown in H&T stores.

By using the Mobile Access Channel to locate an H&T store in your vicinity, you consent to H&T collecting location data from your mobile device solely for the purposes of providing you with details of your closest store.  H&T Waitrose uses this location data anonymously and will not use it for any other purpose.

The Mobile Access Channel is only intended for use by users located in the United Kingdom [and the Channel Islands].  Users accessing the Mobile Access Channel from outside [these jurisdictions][the UK] are responsible for confirming the legality of doing so under local law.

Promotions

You must be aged 18 years or over to participate in any of the promotions that we operate. Underage entries will automatically be voided.

Fraudulent, multiple or incorrectly completed applications will not be accepted, neither will applications made in breach or non-compliance with these terms and conditions.

H&T reserves the right to exclude any applicant from competitions, promotions, events if we believe that an applicant has tried to engage in the promotion via fraudulent or illegal activity (including participation that would be in breach of the law).

H&T in its sole discretion reserves the right to withdraw or vary the terms of competitions and promotions and/or any offer made in connection with them in order to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any applicant for so doing.

The decision of H&T in respect of any matter concerning or related to competitions and promotions is final and no correspondence will be entered into.

H&T accepts no responsibility whatsoever for system damage or connection problems that might affect any end user during any of these promotions.

H&T and its affiliates and subsidiaries, or any of their employees, officers or directors shall not be liable for any damages howsoever arising as a result of a participant's in an event or any such modification, alteration, discontinuance or termination of any offer or promotion, and any such liability shall be borne solely and exclusively by the participant or winner, as the case may be.

You agree that these terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and you submit to the exclusive jurisdiction of the Courts of England.

Surveys

These terms & conditions refer to the competition draw for the customer survey.

1. The Promoter is: Harvey & Thompson Limited (company no.02636684) whose registered office is at Times House, Throwley Way, Sutton, Surrey SM1 4AF.

2. The competition is open to residents of the United Kingdom aged 18 years or over except employees of the Promotor and their close relatives and anyone otherwise connected with the organisation.

3. There is no entry fee to enter this competition.

4. By responding to this survey an entrant will be automatically entered into this competition draw and is indicating his/her agreement to be bound by these terms and conditions.

5. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.

6.  Prizes will be drawn each month, customers must enter the competition within 28 days of receiving the survey.

7. One winner will be drawn at random on first working day of every month and notified in writing or by phone within 28 days of the draw taking place.

We will beat any local rate - Travel Money

  1. We will beat the exchange rate of any local competitor within 3 miles of your local H&T.  Just confirm the name and location of the other provider, the currency, exchange rate, and time and date rate the offer was made.
  2. The offer is only available in-store when you purchase foreign currency and must be redeemed on the same day as seeing the competitor exchange rate, before your transaction is completed.
  3. Only applies to ‘like for like’ transactions under standard exchange rates, where you are exchanging currency for personal use. Cannot be used with any other offer or staff rate.

We will beat any local rate - We Buy Gold

We will beat the amount paid for gold of any local competitor, excluding bullion dealers within a 3 miles radius of your local H&T store.  Just provide a written quotation and confirm the name and location of the other provider inclusive of the carat, weight and time and date the offer was made.

The offer is only available in-store when you are selling gold and the competitors rate must be on the same day as you are transacting in a H&T store. Online rates are excluded. The distance is measured using Google Maps and our decision is final.
